2. PURCHASE AND DELIVERY TERMS
2.1 These purchase and delivery terms (the "Terms") apply when you (the "Customer" or "you") order products at www.thule.com/en-gb (the "Website"). The Terms set out your legal rights and responsibilities, our legal rights and responsibilities and certain key information required by law. By placing an order for products on the Website you accept the Terms. If Thule accepts your order, a legally binding agreement including these Terms is made between you and Thule. 2.2 You should read the Terms carefully before submitting your order on the Website. Thule reserves the right to change the Terms without prior notice to you by updating the Terms on the Website. Your purchase is governed by the Terms available on the Website at the time of your order.
2.3 The Website is only intended for sale to end consumers and orders to addresses in England, Wales, Scotland or Northern Ireland. Unfortunately we do not accept orders from addresses outside England, Wales, Scotland or Northern Ireland.
2.4 To be able to place an order on the Website you must at least be at the age of 18 and have a valid identification document for consignments.
3. PROCESSING OF PERSONAL DATA
4.1 An order is submitted when you press "Complete Purchase". Please read and check your order carefully before submitting it. You then assume a payment obligation for the ordered products. When you have placed an order, Thule will send you an electronic order confirmation as soon as possible by email.
4.2 Please note that it may sometimes take some time before you receive an order confirmation from us. Also check your spam to make sure that the order confirmation has not ended up there. Check that your order confirmation matches your order. If anything is wrong or if you have any questions, please contact us directly by using our contact form here.
4.3 Remember to save your order confirmation so that you have all the information at hand if you have to contact us.
5. THULE’S RIGHT TO REJECT YOUR ORDER OR CANCEL AN ACCEPTED ORDER
The fulfillment of all orders on the Website is subject to availability. We reserve the right to not to accept your order. We also reserve the right to cancel the whole or parts of an accepted order by notifying you in the situations below, without being liable for any damages or costs, other than refund of the amount received from you for the cancelled order:
- the item is not available or not in stock;
- your order is flagged by our security systems as an unusual order or an order that may be related to fraud;
- your billing information is incorrect or not verifiable;
- you are under 18 years old;
- you order as a reseller;
- there is a mistake on the price or description of the item displayed on the Website;
- we cannot deliver to the address you provided; or
- due to circumstances beyond our control (see section 15).
6. PRICES AND PRODUCT INFORMATION
6.1 All prices are stated in Pounds sterling (£GBP)and include applicable value added tax. Delivery cost may apply depending on the selected delivery option. The total cost of the order including delivery cost is always displayed before the order is completed.
6.2 If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.
6.3 The product images on the Website are for illustrative purposes only and, although we have made every effort to display the products accurately, should not be considered as a binding promise that the exact appearance and nature of the product is displayed. Thule reserves the right to change any incorrect product information and prices without prior notice.
7. PAYMENT OPTION

8. TRANSFER OF OWNERSHIP
We reserve the right of ownership of all products until we have received full payment for these.

10. CANCELLATION OF ORDER BEFORE DELIVERY
You can cancel your order free of charge and without giving any reason, provided that the products have not left our warehouse. In such a case, no costs are added. You can find the status of your order on your personal account on the Website (insofar you were logged in when you placed your order) or by contacting us directly using our contact form.
11. RIGHT TO CANCEL YOUR PURCHASE
11.1 According to the consumer legislation, you are entitled to cancel your purchase for no particular reason within fourteen (14) calendar days from receiving your order. In such a case, return of the product shall take place within fourteen (14) calendar days from the date you exercised your right of withdrawal.
11.2 You are entitled to open the package and examine the product to the extent required to assess whether you are satisfied with it. If the product has been handled to a greater extent than was necessary (to determine qualities and function) and is not in a substantially unchanged condition, Thule reserves the right to make deductions for depreciation from the amount to be repaid. All possible accessories must be included with the return. If you regret your purchase, we will refund the amount you have paid excluding fees for payment methods and delivery costs within fourteen (14) calendar days from the date of approval of your return or your presentation of a delivery receipt. Please note that you, as a Customer, are responsible for the cost and risk of the return.
11.3 Right of withdrawal does not apply to specially ordered products that have been manufactured according to your instructions or otherwise have been given a personal touch.
11.4 In order to exercise your right of withdrawal you have to contact us. You are free to choose how you want to contact us (by post or email). Feel free to use the return slip that accompanies your order or fill in our return form. If you choose to fill in our return order form on the Website, we will acknowledge receipt of your notice as soon as possible.

12. PRODUCT ISSUES AND COMPLAINTS
12.1 The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:
12.1.1 Up to thirty (30) days: if your goods are faulty, then you can get an immediate refund.
12.1.2 Up to six (6) months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.
12.1.3 Up to six (6) years: if your goods do not last a reasonable length of time you may be entitled to some money back.
12.2 Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015. You may also have other rights in law.
12.3 Once you have received your order, you should immediately check that the content is correct and that the products are free of defects. In the event of a defect in the product, incorrect delivery, delay in delivery or transport damage, as a Customer you are obliged to contact Thule within a reasonable time after you discovered the defect using the contact details in paragraph 1 of these Terms. A complaint made within two (2) months from the time you discovered the defect is always considered to have been made within a reasonable time.
12.5 When Thule has received the complained product and found that the complaint is approved, Thule will reimburse you in accordance with current consumer legislation. This means that the defect will be remedied or that a new item will be sent. If this is not possible, or if Thule otherwise considers it more cost effective, a refund may instead be made. If, on the other hand, it is found that the complaint is not approved, the item will be returned to you. Please note that you bear the cost of the return when an item is returned to us. However, if your complaint is approved, we will refund the return cost. The assessment of a complaint can take up to fourteen (14) calendar days.
13. LIMIT ON THULE'S RESPONSIBILITY TO YOU
13.1 Except for any legal responsibility that Thule cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, Thule is not legally responsible for any:
13.1.1 Losses that were not:
(a) foreseeable to you and Thule when the contract was formed; or
(b) caused by any breach on Thule's part;
13.1.2 business losses; and
13.1.3 losses to non-consumers.
14.1 In addition to your statutory rights, Thule offers its own product guarantees through the "Thule Guarantee" and the "Thule Extended Warranty". These guarantees do not affect your statutory rights.
14.2 Thule Guarantee –The Thule Guarantee covers defects or damage that affects your product. This applies also to damage caused by normal wear and tear or natural discoloration of materials up to two (2) years from the date of purchase by the original purchaser.
Thule reserves the right to:
- repair products covered by the terms of the Thule Guarantee;
- replace products when damage or defects cannot be repaired; or
- offer a similar product of comparable value or refund the purchase price.
The Thule Guarantee does not cover defects caused by circumstances beyond Thule’s control. These include, but are not limited to, misuse, overload or failure to mount, mounting or use of the product or its accessories in violation with Thule’s written instructions, guidelines or safety information. Nor does the Thule Guarantee cover any damage of the user’s vehicle, electronic devices, load or other individual or property.

14.3 Thule Extended Warranty–The Thule Extended Warranty applies to products manufactured by Thule and which have been sold to the original purchaser under the brand Thule. The warranty covers defects in materials and workmanship and applies, depending on the product type, for a certain number of years from the date of the original purchase. See the total length of guarantee (Thule Guarantee and Thule Extended Warranty) applicable to the each product here.
Subject to the limitations and exceptions described in the warranty, Thule will remedy defects in materials and workmanship during the warranty period by repairing or replacing(the measure to be determined by Thule)defective components without charging for parts or labour.
Register your Thule product with us within two (2) years from the purchase to make sure that you have a valid Thule Extended Warranty.

As soon as a return has been handled by us, a refund will be made to the payment method you used at the time of ordering within 14 calendar days from the time you became entitled to a refund. If you ordered and paid for your order with a credit card, we will refund the money to the card. If you ordered and paid by a Klarna Checkout invoice or partial payment, repayment will be made via Klarna. On repaying products paid for with direct bank payment, we will deposit the amount in your bank account within 14 calendar days from the time you were entitled to a refund. Be sure to include all necessary account details.
16. CUSTOMER’S RIGHT TO ASSISTANCE
16.1 As a consumer you are always entitled to turn directly to Thule for assistance with complaints, right of withdrawal and other assistance in connection with your purchase or order. 17. CIRCUMSTANCES BEYOND THULE’S CONTROL
17.1 A circumstance beyond our control means an act or an event beyond our reasonable control, including, but not limited to, strikes, lockouts or other similar acts by a third party, civilian insurrections, riots, terrorist attacks or threats of terrorist attacks, wars or threats of war, fire, explosions, pandemics, epidemics, floods, earthquakes or other natural disasters or faults in public or private telecommunications networks.
17.2 If an event beyond our control occurs that affects our ability to fulfil our obligations under the Terms, we will contact you as soon as possible and the time for our fulfilment of our obligations under the Terms will be extended for the duration of the event beyond our control. You have the right to cancel your order if an event beyond our control occurs and which prevents our delivery of an item to you.
18.1 The content of the Website is copyrighted and belongs to Thule. The information on the Website is including, but not limited to, stills, moving pictures and sounds and text and layout must not, besides for purely private purposes or where it is expressly permitted, be copied, reproduced, altered, transferred or stored in any form whatsoever. Modifying the content of the Website is prohibited.
18.2 Logos on the Website belong to Thule. It is not permitted to use Thule’s trademarks or logos, in paper form, digitally or in any other medium.
18.3 The information on this Website may contain technical defects or typographical errors. Feel free to contact our customer service to report such a technical defector a typographical error.
18.4 The contract based on these Terms for the supply of the products in your order is between you and Thule. No other person shall have any rights to enforce any of its terms.
18.5 If Thule does not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent Thule taking steps against you at a later date.
18.6 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
18.7 These Terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
